1Acceptance of these terms
These Terms of Service (“Terms”) govern your access to and use of the InstaSupply websites, applications, and services (together, the “Services”), operated by InstaSupply, Inc. (“InstaSupply,” “we,” “us”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
2What InstaSupply does
InstaSupply is a marketplace that connects contractors and other buyers with local suppliers of construction materials, and arranges delivery through delivery partners. We are not the manufacturer or, except where expressly stated, the seller of the products listed. Product availability, pricing, descriptions, and fulfillment are provided by the suppliers.
3Accounts and applications
Some features require an account or an application (for example, applying to become a supplier or a delivery driver). You agree to provide accurate, current, and complete information and to keep it up to date. You are responsible for activity that occurs under your account and for keeping your credentials secure.
4Orders, pricing, and delivery
Orders placed through the Services are subject to acceptance by the relevant supplier. Prices, taxes, fees, and availability may change. Delivery options — including pickup, same-day, next-day, and scheduled delivery — depend on the supplier and the delivery network in your area. Estimated times are not guarantees.
5Acceptable use
You agree not to misuse the Services, including by: using them for unlawful purposes; interfering with or disrupting the Services; attempting to gain unauthorized access; scraping or harvesting data; or submitting false, misleading, or fraudulent information.
6Intellectual property
The Services, including their content, design, and trademarks, are owned by InstaSupply or its licensors and are protected by law. You may not copy, modify, distribute, or create derivative works without our permission, except as allowed by these Terms.
7Third-party services
The Services may rely on or link to third parties (for example, payment processors, delivery partners, and analytics providers). Your use of those services may be subject to their own terms, and we are not responsible for them.
8Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or that products listed will meet your requirements.
9Limitation of liability
To the fullest extent permitted by law, InstaSupply will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising from or related to your use of the Services.
10Changes to these terms
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
11Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws principles.
